Bro. Anlger said he would present one case at first, and he had two or
three more of a like nature,, said he was called upon by brother Tubs
to look a cow, which brother Tubs said brother, Meaham had struck
with a hand spike,, and he and Bro. Tubs,, and he and brother Tubs
went over to see brother Meacham,, and Brother Meacham denied striking
the cow but said he threw the stick at her and hit her..
Counselor H. W. Miller withdrew & Moses Clousen took his place..
Brother Meacham still denied striking the cow..
Amos Tubs testified that as he was coming down back of
Mr Heywards he saw Bro. Meacham, hauling some wood, and heard
him hollo to his children and say he could whip them for letting the
cattle into the yard; and when he came up to them he did
whip them, and as he tho't me as he should a balky
horse than as a father would to corect a child,, and
as he passed on he saw Mechan running with a hand-
spike, and he struck the cow with it,, raising it at full
swing over hes shoulder,, he hit the cow on her hip and
with such force it caused her to reel,, said Mecham
to strike again but the cow was out of his reach,,
he then threw the hand spike and hit her with
it again, at that time Mecham's son came runing into
the gap and turned the cow back into the yard,, the yard
fence was opened for two or three pannels so there was
nothing to hinder the cattle from going into the yard..
Solon Basset Testified that two weeks ago last
Friday he was chopomg on the side hill above Bro. Mechams,
and saw Bro. Macham coming with a drag of wood, and
heard him crying out to his children to drive the cattle out
of the yard, and threatene'd to whip the children for letting
them into the yard which he did when he came up whiping
the boy at the door and the girl in the house,, he then
followed the cow with a club, and he saw him strike the
cow with the club and then threw the club and hit her
with it,, was positive he hit the cow both when struck at
her and when he threw the club..
