of facts, as near as I can recollect them.. Mary Taylor
The affidavit of Mary Louisa Taylor was then read as follows (To wit)
Dec. 2nd 1847. Joseph Warthon came to Joseph Taylors last Saturday
a week ago.. I knew nothing of any fuss between them till hearing some loud talk
I went out and Warthon was a damming Joseph for following him with
his knife.. Joseph had his shoe and knife both in his hand.. Joseph said he
would take his knife out of his right hand, and put it in his Cane
hand.. Warthon threatened to knock Joseph's teeth down
his his throat,
Swore he would knock his brains out.. Jumped and got the ax..
Drawed it up and swore he would knock his brains out at this time..
Joseph's wife jumped in between them,,Warthon continued to try to
get hold of Joseph, and drew the ax up two or three times,,reached
over his wife so as to get hold of Joseph's collar like and pushed
him against the house.. Warthon gave way a little,, I then
told them if they was going to fight, to give me the ax, he then flung
the ax away.. Mary then pushed Joseph into the door and into the
house.. Warthon then told me to tell Allen that he intended to
have his pay, that Joseph had stolen enough from the boys as they
came home to pay the debt.. Joseph said he would make him prove
it..Joseph said he sent him word that he has cut the hay, and
Warthon said he had to go off and could'nt hual it,, and it got spoiled
I suppose.. The hay I know nothing about.. This is about all I he collect
that passed,, My little girl and his wife kept Joseph in the house, and
Warthon went of swearing he would make Joseph pay him now
any how.. Mary Louisa Taylor..
The affidanit of Jackson Smith was then read as follows(wit)
Dec. 10. as I was called for to go with Joseph Taylor to present
the writing to Mr. Warthon, he call M. Taylor a liar several times
and he said he could prove it.. Jackson Smith..
As Bro. Warthon did not appear on the trial after being duly
notified,, a question arose whether it was proper to try the case in his
abscence,, The council considered that Bro. Warthon treated the Priest-hood
with contempt in not appearing.. Bro Taylor also testified that
when he presented the notice to him, he replied he should no
more for the council than he did for the wind that blows &c,,
