Council Point Aug. 7th AD 1847
Council opened with prayer be H. W. Miller; present Jas Alred
Heman Hyde, Geo. Coulson H.W. Miller, Wm Snow, N. S. Bulkley.
Lyman Stoddard Evan M. Greene; the places of A. H. Perkins W. G. Perkins,
B. F. Bird & Ira Oviatt were filled by Moses Clawson Wm Draper,
Jacob Bigler & Thos. Guyman___The Clerk read the former
minutes_ Then read a charge preferred against John P. Bernard,
by Elijah Mellin(vi) for buying property of Hozea W. Tinker, belonging
which said Bernard knew belonged to Job Sidwell_____
Bernard reported himself ready for trial.. The case was
opened by said Mellin making his statement, (vis) he understood
said Bernard had from $150, to $ 200, of Job Sidwells property..
Bernard confessed he had bought a wagon and oxen of H. W.
Tinker,, said he turned out a more rated at $130 and allowed
$110 for the oxen and wagon, and got the rest in a bed, bedding and dishes..
Jacob Baum testified that his brother, John Baum, told him
that Tinker had paid $160, in trade, and he replyed it was a hard bargain..
He saw Tinder back the other side of Mr. Pisgah as Tinker went
down after getting the money of Job Sidwell,, and said Tinker told
him, Sidwell had let him have money to go to St. Louis to get
good groceries &c also to buy a wagon and oxen, and as his
family was small he was to bring it along with him in the
wagon for his trouble.. Said Tinker lost his child while he was
back there, his wife was taken sick on the road and died soon
after his arrival at the Bluffs;; and he manifested the spirit of
apostacy from the time he came back here.. Sidwell was gone
down to St. Jo. and Tinker sent him but one word that he gotten
Amos P. Hone stated he had heard Bernard say if he had not
have supposed Tinker was honest and meant to settle with Sidwell
he would not have bought his property..
Wm Mendonhall testified he was present when Bernard first
came to see Tinker,, Bernard said his mare cost him $300, but as it
was he would tak $150, how they traded he knew not
