Fields to see Tinker while he was in Mo.after he had
left here and a letter read by Fields, to Tinker, requesting
Tinker to send to Sidwell his oxen and waggon, by
Fields, and that Sidwell must have learned by Fields
where Tinker was and he remained there long enough
for Sidwell to have secured his pay of him; testified his
had told him before that the property belonged to Sidwell.
   Francis Lawrence Testified, that Tinker offered his
property to him. for sale, and wished him to circulate that he had
such property for sale, stating he had borrowed money of a man
who was below and he wanted to get it into money again so
as to go and settle with him.. He did not know but the man
would come to get the oxen and waggon if so he would have
them, testified also he and  brother Pendleton went over to see
his goods &c.. Bro, Pendleton bought considerable of his flour..
Rausom Bernard Testified that he understood his
father got for the mare $130. in 1 waggon at $100.,--1 pair of
oxen at $10. and the other $20. he got a bed bedding and
some dishes, but he was not present at the time of the
trading..
   John Bearnard, testified, He told Bro Mellin
There was the  Tinker waggon his father  bought.. the
other three standing near one his father bought
and the other two they bought the woods and
------ them, themselves.. He denyed telling
Mellin his father got $200. for the mare..
   Eligah Mellin stated he had told the truth,
and he knew the young man was lying when he said
they got two pairs of oxen &c..
WMendonhall stated it beingwas late when
Tinker came on, but as he expected Sidwell up for
the cattle he would not send them to the rushes
 and did not buy hay to feed them, &c..
   Resolved the whole council into committee
and voted to with draw..
