Egbert Elsworth 2 witness conincided in full with
the first witness..
Samuel Williams 1st witness for defendant, testi-
fied that at the agreement before the
Bishop they were to pick out of Bro. Cutlers's
stock of cattle such a creature as would
come the nearest to the debt,, said Bro.
Cutler called on him and Bro Stevens
and they appraised one of the old oxen,
said when they went into the yard Bro.
Cutler said there were the two old oxen
he wanted to turn one of them out..
John Stevens 2 witness said he understood the
debt was to be paid in stock but did
not understand all the other witnesses
had testified, Bro Cutler called on him
and Bro. Williams, and they prised the
one,, prosed him at $ 16,50..
Councillor Snow considered that Bro. Nelson
had sustained his charge..
Councillor Perkins said if Bro Nelson had
sustained his charge it was because he had
the best witnesses..
Bro. Nelson had nothing to say..
Bro Cutler made some remarks but to
no purpose on the point..
Pres. Allred, sustained the Bishops decission
and said Bro. Culter should turn out good
stock and have the two men chosen
appraise said stock
The Council sustained him.
