2 Wt. Noah Packard know that the two Biglers drew logs for
them and when the money was paid it was paid to the old
gentleman knew notting of any articles of Partnership
existing between them
The clerk read the testimony of A. C. Willson =
3 Wt J. B. Stutsemen- testified that he did not make a bargain in with Mr. Bigler, I made my Bargain with you, and you
got Mr. Bigler, and when the day came to load up you
did not come but Mr. Bigler came and one had your
team- I judge him a partner with you as he attend the
weights= I paid some to the old gentleman & some to Adam-
I made a contract with Mr. Caldwell= I am the conclusion
that they were in partnership because the old gentleman took
the responsibility of the altering the weights=

1 Wt Adam Bigler said Caldwell told him he had a load for
Stutsmen and then was another= I went and saw Stutsman
when the day came Caldwell was sick I told Stutsmen that I would go
and see Caldwell= I met him in the street asked him what he
would take for his team to go up with - he said if I would find a
driver we would go haves in the load= I got Mark to go and
drive= He and his father were not in partnership= He did not ask
his fathers advice or council in the matters=
At the close of his testimony the Council had 5 minute recess=
2 witness mark Bigler confirmed the testimony of A.B.- he drove
the team for Adam=
Bro. Caldwell acknowledged that he called R. W. Bigler a [===]
scoundrel= That he said the old man looked to him like a
man that was laboring under the curse of God- that he
would not give it up he would appeal and would have it out
of him if it tool him three years=
