Pisgah together the fore part of May A.D. 1848 & Cooley told him
that he and Gould were a going to build a grist and saw
mill- nothing was said about the claim- he worked thirty
days on the mill be understood all the time that the claim was
in partner ship- Gould was on the claim when they came up and
he supposed that Gould had been making these preparations- the
agreement was made between the parties- They sent for some
of his tools four or five days before he commenced work- and
he commenced work the 31st day of July- two long sticks were got
out and the timber of the old mill from Winter Quarters was
hauled to the spot- Bro. Cooley boarded more hands while building
the mill than Bro. Gould did - the most of the timber for the
dam & for the grist mill was paid for out of a horse sold by Cooley
some timbers were got out that he did not know who paid
for them- he had got the most of his pay- had received pay of
both parties had received the most of Cooley.---
3rd Witness Aaron W. Cook. Testified that during the summer
of A.D. 1849 he worked as miller in the mill if Messers, Cooley &
Gould, and he judged from the way the Cooks were kept the
monies divided, and the drafts drawn that they were equeal
partners, and from all that he could learn the firm was a firm
of Equeal Capital between them at that time, did not know
on any bargain of contract, relative to business between the parties
Cooley did the most of the business out from home-he should
judge that Cooley did bear more then one half of the Expense
he was Employed by Cooley boarded by Cooley and was considered
Cooleys hand- he received his pay out of the mill-
4th Witness John D. Parker, Testified that he had assessed that property
twin but he could not testify with certain without seeing the
roll= Bro Cooley said it was asked who took the head in the com-
pany and said that was no difference= Gould said it was Cooley
and Gould= witness said he was strongly of the opinion that the
firm was Cooley & Gould = Bro. Gould then presented the Indenture
of sale between Cooley & Gould and Thomas Bateman read by the
clerk-- 5th Witness Benj. Gardner testified- he was tending the
grist mill of Cooly and Gould- he agreed with the two together
he supposed them Equeal in the firm when money was paid him
