Thomas McKenzie first witness testified
that the said Derby Came to his House on the Evening
of the 4 of Augst 1850 professing to be visiting the sick
and was very much intoxicated and acted very impu-
dent with his wife who was very sick nigh unto death
and the said E H Derby unbuttoned his pantaloons
and exposed his nakedness and made watter on the
floor in the presence of thre or four females in
a drunken and brutish manner Ruth Page's
depositaon was taken by Councillor J G Bigler
which corroborated with the above testimoney
witness McKenzie further stated that on the fifth
of August the said Derby met him in front of
Brown & Millers Store and hearing that he had
told of (his {Derbis) conduct the Evening previous
and struck McKenzie three times with his fist
(severe blows) before he could be prevented by those
standing by, and that he had not nor would not
make any retraction nor ask the forgiveness of him
-self neither the females who ware insulted by
him and the said Derby was Cutoff of the C of JC of LDS by the Court for
contempt to court his conduct in the foregoing case
and his General Course of disgraisful Conduct
