claim then,, and Bro Haws told him, his boys were
making a claim there,, this took place about the
time the Indians left the place,,
3rd witness Nathaniel Haws testified that he and his father
and brother worked on the claim last fall,, testified that
Handrise claimed the rails,,also said that Burt
stated when he went on there he expected there
would be a fuss about it,, but he would let them
fuss it out and then he would buy the claim
of the one that gained it..
4th Rufus P. Stewart testified that he was present when
his brother paid Haws for the claim, he never heard
Haws say he did not claim the rails, did not know
that any one claimed the land but his brother after
he bo't of Haws, he heard Haws say he bo't the claim
of the Indians chief.. A certficate from Johnin A Hardin as
testimony on the part of the planitve was then presented
5th witness,, Sarah Hendrise, testified that her husband bo't
the rails of the Canada boys, and she heard the chief
promise the claim to her husband,, and further testified
that she saw [------] Cline handing off the rails and
she requested him to stop and he did so..
6th witness, Henry Ettleman,, testified that some time last
summer he told Bro Hendrise to buy the claim of the
Indians, and he would take it if he could get it at
a low rate,, but knew nothing of the purchase only
what bro. Hendrise told him,, further testified that the
Indians told him he might go to work on the place
if he would not inerfere with the corn,, did know that
Stewart had any claim on the place..
7th witness Wm B. Simmons testified that he was not present
at the time the bargain was made, but heard bro. Stewart
say after Bro Burt had moved onto the claim he was
sorry for he meant to have bo't the claim if he did
not go to the Valley..
8th witness,, W.. Burt testified that he heard that Bro's
Haws and Hendrise had each bo't the place and
