Witness for defendant Garrett Miksell- Remarks from several
of the Counsellor- Counsellor Browning made a few remarks
said the Council understood the case as well as himself that
the case was a plain one, said it was evident that the charge
was sustained, and they submitted the case..
     Counsellors Bigler arose and said in behalf of the
defendant he should plead for mercy to be  extended
     Bro. Gould arose and said had extended mercy
until it had ===== to be a virtue, he had called on Cooley
for possession of the property it had not been given- said Cooley
had tried to sell the mill since he was notified on this charge
     Cooley arose and said it was his time to take the floor, said
they agreed to leave the mills to keep correct accounts of
all the proceeds of the mills untill they settled, this I hear
been willing to do I did not think it throwing contemp on
the Council= President Allred arose and said he had testimony
that Cooley had said, their intention was to have been Equeal
partners in the mill and the witness on hand to prove it,
after some remarks said his mind is the chage is fairly
sustained, and that Cooley give Gould possession of the mill
during next week, or that Cooley be cut off from the church
of J.C. of L. D. S. and on motion his virues were sustained by
the Council unanimously.
     Cooley then called for an appeal to the first presidency
in G. S. Lake valley- Counsellor G. W. Harris objected untill
 he should comply with the decision of the Council.

   Counsellors Coulson arose and spake on the spirit of
appealing to the first Presidency which was very much to
the point.. Remarks from several of the Counsellor. Counsellor
Stoddard showed that Cooley had a bad spirit..
  Counsellor Harris motioned that Cooley can not have an
appeal untill he complies with the decission of the Council..
    On motion the Council adjourned two weeks
